An analysis of a broad sample of Dutch judicial and semi-judicial decisions shows similar structures as the ones Bhatia and Mazzi found before. The question is posed what explains this seemingly unchangeable judicial format. From a perspective of argumentative and communicative efficacy and comprehensibility, the format is certainly not the optimal choice. The explanation is that the format is a sign of an ideology. The format suggests an objectivity of the decision taken. This is actually a myth. This makes a (...) decision to change the format an ideological one. (shrink)

Argumentation is a cognitive category. Texts cannot be said to be argumentation, nor can argumentation be said to lie in texts. This is an almost trivial semiotic point of departure, but it is quite relevant nevertheless. In this contribution, three reasons are developed to emphasize and to articulate the semiotic component of argumentation to show that it is a crucial element that cannot be disregarded. Two of these reasons are mentioned only in passing as other contributions in this volume deal (...) with them more substantially. The third reason, being that argumentation requires an exchange of discourse worlds and that consequently the mimetic construction of these discourse worlds is part of the argumentation, is discussed in some detail in this paper. It will be argued that a lack of attention for the mimetics of argumentation is regrettable, both theoretically and practically. Focusing on the mimetics raises questions concerning the dominant ‘propositional’ format of argumentation assumed to be essential for argumentative assessment. (shrink)

When we define argumentation as a communicative activity aimed at convincing a reasona-ble critic of the acceptability of a standpoint by putting forward information justifying or refuting this standpoint, it is clear that elements of this information can be brought forward in other than verbal modes. An important question is then whether visually presented information needs to be translatable into a set of propositions as traditional definitions require. The answer is: not always.

A systematic rhetorical analysis may reveal elements of multimodal argumentative discourse that would otherwise remain hidden. In this article, we present simultaneously the basics of the method we have developed to integrate theories about different modalities in one parallel processing framework for rhetorical analysis and the results of its application to an intriguing ad.

This paper addresses the question how to analyze multimodal public discourse in such a way that the resulting reconstruction of the rhetor’s accountability either obliges the rhetor to acknowledge the argumentative reconstruction as valid or to refute its validity in a meta-discussion. This is a challenge for discourse theory as well as for argument theory because multimodal discourse seems far removed from the ‘standard’ propositional format of an argument. We argue that multimodal discourse should be analyzed as a coherent and (...) relevant discourse, assuming the possibility of instant interactions between all modes. We introduce a method that allows us to account for an argumentative reconstruction in a systematic way. We illustrate our method by analyzing the ABC news item titled Hu Jintao Visit: Economics and Panda Bears of January 20, 2011, holding ABC news as a rhetor accountable for several far reaching standpoints that are implied in the multimodal format. In modern argument theory argumentative practice is often analyzed and evaluated in terms of its correspondences with or deviations from a normative model. Such a methodology implies that there are three moments at which evaluations takes place which are not guided by the norms of the model itself because they imply an interpretation of the model by the analyst. This is demonstrated by an analogy with legal practice. this implies that an evaluation of an argumentative practice is not only relative (...) to choice of the normative model as such, but also relative to the threefold interpretation of the model. An argumentative text can be reconstructed as an argumentative discussion between a protagonist and an antagonist. However, such a text is usually not a literal report of a discussion. It is the author of the text who determines how issues are presented, how claims are modeled, how the development of the discussion is presented. Especially when a text has embedded discourse voices that can fulfill the roles of protagonist or antagonist, the author of the text can strongly suggest a specific (...) assignment, suppressing alternatives. In this article examples are presented that show how an author exploits linguistic means—a strategic choice of causal connectives—to suggest a specific reconstruction. The question is raised whether a derailment of this behavior of the author should be characterized as committing the fallacy of the straw man. (shrink)

Sarah Richmond’s translation makes an important contribution to Sartrean scholarship. L’Etre et le néant was first translated by Hazel Barnes in 1956 but it contained various errors. Richmond also had access to the internet and to Sartre’s French and German sources. Her edition also contains an Introduction and a ‘Notes on the translation’ section.Sartre published his work in 1943 and, unable to access all the works he cited, he often did so from memory. He also adopted certain translators’ neologisms: for (...) example, Corbin’s translation of Heidegger’s Qu’est-ce que la métaphysique?, and when he quoted Nietzsche, he used two different translations, and he quotes Spinoza using a text by Hegel. He quotes a line from the playwright Beaumarchais without clarifying the context.Sarah Richmond deals with many of these problems and also notes that the French gender system can be problematic. Also, Sartre’s neologisms rendered finding English equivalents difficult. This is an excellent translation. (shrink)

The rapid dynamics of COVID-19 calls for quick and effective tracking of virus transmission chains and early detection of outbreaks, especially in the “phase 2” of the pandemic, when lockdown and other restriction measures are progressively withdrawn, in order to avoid or minimize contagion resurgence. For this purpose, contact-tracing apps are being proposed for large scale adoption by many countries. A centralized approach, where data sensed by the app are all sent to a nation-wide server, raises concerns about citizens’ privacy (...) and needlessly strong digital surveillance, thus alerting us to the need to minimize personal data collection and avoiding location tracking. We advocate the conceptual advantage of a decentralized approach, where both contact and location data are collected exclusively in individual citizens’ “personal data stores”, to be shared separately and selectively, voluntarily, only when the citizen has tested positive for COVID-19, and with a privacy preserving level of granularity. This approach better protects the personal sphere of citizens and affords multiple benefits: it allows for detailed information gathering for infected people in a privacy-preserving fashion; and, in turn this enables both contact tracing, and, the early detection of outbreak hotspots on more finely-granulated geographic scale. The decentralized approach is also scalable to large populations, in that only the data of positive patients need be handled at a central level. Our recommendation is two-fold. First to extend existing decentralized architectures with a light touch, in order to manage the collection of location data locally on the device, and allow the user to share spatio-temporal aggregates—if and when they want and for specific aims—with health authorities, for instance. Second, we favour a longer-term pursuit of realizing a Personal Data Store vision, giving users the opportunity to contribute to collective good in the measure they want, enhancing self-awareness, and cultivating collective efforts for rebuilding society. In computer ethics, as in other branches of applied ethics, the problem of the justification of moral judgment is still unresolved. I argue that the method which is referred to as “The Method of Wide Reflective Equilibrium” (WRE) offers the best solution to it. It does not fall victim to the false dilemma of having to choose either case‐based particularist or principle‐based universalist approaches to the problem of moral justification. I claim that WRE also provides the best model of practical (...) moral reasoning available for computer ethics. It does not pretend to provide quasi‐algorithmic procedures for moral decision‐making, but neither does it abandon the regulative ideal of communicative transparency in discursive public justification. Vaccination programmes against infectious diseases aim to protect individuals from serious illness but also offer collective protection once a sufficient number of people have been immunized. This so-called ‘herd immunity’ is important for individuals who, for health reasons, cannot be immunized or who respond less well to vaccines. For these individuals, it is pivotal that others establish group protection. However, herd immunity can be compromised when people deliberately decide not to be immunized and benefit from the herd’s protection. These agents (...) are often referred to as free riders: their omissions are deemed to be unfair to those who do contribute to the collective’s health. This article addresses the unfairness of such ‘free riding’. An argument by Garett Cullity is examined, which asserts that the unfairness of moral free riding lies neither in one’s intentions, nor in one’s reluctance to embrace a public good. This argument offers a strong basis for justifiably arguing that free riding is unfair. However, it is then argued that other considerations also need to be taken into account before simply holding free riding against non-compliers. (shrink)

It has been argued that the Internet and social media increase the number of available viewpoints, perspectives, ideas and opinions available, leading to a very diverse pool of information. However, critics have argued that algorithms used by search engines, social networking platforms and other large online intermediaries actually decrease information diversity by forming so-called “filter bubbles”. This may form a serious threat to our democracies. In response to this threat others have developed algorithms and digital tools to combat filter bubbles. (...) This paper first provides examples of different software designs that try to break filter bubbles. Secondly, we show how norms required by two democracy models dominate the tools that are developed to fight the filter bubbles, while norms of other models are completely missing in the tools. The paper in conclusion argues that democracy itself is a contested concept and points to a variety of norms. Designers of diversity enhancing tools must thus be exposed to diverse conceptions of democracy. (shrink)

When thinking about ethics, technology is often only mentioned as the source of our problems, not as a potential solution to our moral dilemmas. When thinking about technology, ethics is often only mentioned as a constraint on developments, not as a source and spring of innovation. In this paper, we argue that ethics can be the source of technological development rather than just a constraint and technological progress can create moral progress rather than just moral problems. We show this by (...) an analysis of how technology can contribute to the solution of so-called moral overload or moral dilemmas. Such dilemmas typically create a moral residue that is the basis of a second-order principle that tells us to reshape the world so that we can meet all our moral obligations. In the age of Big Data, companies and governments are increasingly using algorithms to inform hiring decisions, employee management, policing, credit scoring, insurance pricing, and many more aspects of our lives. Artificial intelligence systems can help us make evidence-driven, efficient decisions, but can also confront us with unjustified, discriminatory decisions wrongly assumed to be accurate because they are made automatically and quantitatively. It is becoming evident that these technological developments are consequential to people’s fundamental human rights. Despite increasing attention to (...) these urgent challenges in recent years, technical solutions to these complex socio-ethical problems are often developed without empirical study of societal context and the critical input of societal stakeholders who are impacted by the technology. On the other hand, calls for more ethically and socially aware AI often fail to provide answers for how to proceed beyond stressing the importance of transparency, explainability, and fairness. Bridging these socio-technical gaps and the deep divide between abstract value language and design requirements is essential to facilitate nuanced, context-dependent design choices that will support moral and social values. In this paper, we bridge this divide through the framework of Design for Values, drawing on methodologies of Value Sensitive Design and Participatory Design to present a roadmap for proactively engaging societal stakeholders to translate fundamental human rights into context-dependent design requirements through a structured, inclusive, and transparent process. Information technology is an integral part of the practices and institutions of post-industrial society. It is also a source of hard moral questions and thus is both a probing and relevant area for moral theory. In this volume, an international team of philosophers sheds light on many of the ethical issues arising from information technology, including informational privacy, digital divide and equal access, e-trust and tele-democracy. The discipline of ethics must take this constitutive feature of institutions and technology into account; thus, ethics must in turn be embedded in our institutions and technology. The impact of the Internet on democracy is a widely discussed subject. Many writers view the Internet, potentially at least, as a boon to democracy and democratic practices. According to one popular theme, both e-mail and web pages give ordinary people powers of communication that have hitherto been the preserve of the relatively wealthy (Graham 1999, p. 79). So the Internet can be expected to close the influence gap between wealthy citizens and ordinary citizens, a weakness of many procedural democracies.

The main object of this study is to find out whether the differences between classical and medieval thinking about work, occupations and technology are so significant that we are justified in speaking of a real break between Antiquity and the Middle Ages in this connection; or whether there is a possible continuity of ideas. From a comparative perspective five themes are being researched to shed light on this ques-tion. In the first two chapters the author looks into the traditional view (...) of negative ideas about work in Antiquity. Chapter three subsequently deals with monks and their attitude towards labour. In chapter four the place of the so-called artes mechanicae in medieval classifications of knowledge is being studied. In chapter five we find an analysis of twelfth-century sermons ad status. These three chapters principally deal with the question whether Christianity brought about a change in attitude towards work. (shrink)

Stimulating responsible conduct of research is considered important within universities and research organizations. In this contribution, we investigated if there are gender differences regarding three aspects: students’ attitudes towards integrity related issues, self-reported misconduct, and suspicions of misconduct and willingness to report fellow students. A questionnaire was sent to 1266 first year starting master students in the life sciences. Male students were significantly more likely to report not doing their fair share in group work and putting their name on work (...) without checking it. No significant differences were found regarding attitude and suspecting and reporting other students. (shrink)

Trainers often use information from previous learning sessions to design or redesign a course. Although universities conducted numerous research integrity training in the past decades, information on what works and what does not work in research integrity training are still scattered. The latest meta-reviews offer trainers some information about effective teaching and learning activities. Yet they lack information to determine which activities are plausible for specific target groups and learning outcomes and thus do not support course design decisions in the (...) best possible manner. This article wants to change this status quo and outlines an easy-to-use taxonomy for research integrity training based on Kirkpatrick’s four levels of evaluation to foster mutual exchange and improve research integrity course design. By describing the taxonomy for research integrity training (TRIT) in detail and outlining three European projects, their intended training effects before the project started, their learning outcomes, teaching and learning activities, and their assessment instruments, this article introduces a unified approach. This article gives practitioners references to identify didactical interrelations and impacts and (knowledge) gaps in how to (re-)design an RI course. The suggested taxonomy is easy to use and enables an increase in tailored and evidence-based (re-)designs of research integrity training. (shrink)

This volume deals with a number of topics that have not previously been specifically addressed before in a single text. A chapter on Sartre and religion talks about his thought in relation to Christianity, Judaism and Buddhism, while one on Sartre and children discusses his work in relation to the issues of freedom, pregnancy and autism. Beyond this, there are an additional seven chapters covering a wide variety of topics by leading scholars in the fields of philosophy, literature psychology, history (...) and political thought. While prior publications on Sartre have generally divided his work into two periods, pre-and post-Marxist, this volume deliberately stresses a middle and final period as well. As representative of the middle period, there is an emphasis on Notebooks for an Ethics, while Sartre's last work, Hope Now, is also treated as being philosophically significant in its own right. This approach helps to cast a new light on what Sartre has to say about authenticity, childhood and consciousness as embodied, among other subjects. The volume also addresses many and diverse issues of current interest, including those of freedom, Marxism and Sartre's relation to ethics. There are sections of the book that deal with history and the historical situations that helped to shape Sartre's thought, as well as articles that deal with Sartre as a specifically French thinker. A chapter deals with Sartre's relation to women , and here the issues of maternity as problematic, plus authentic, adult relationships are discussed. Finally, in addition to authors in philosophy and literature, there are articles by a child psychiatrist and a clinical psychologist to help to provide new insights on Sartre's work. Even as an academic philosopher Sartre always remained an iconoclast and the aim of this book is, at least partially to capture and provide the reader with insight into this spirit. (shrink)

We provide a description and informal analysis of the commonalities in moral discourse concerning issues in the field of information and communications technology, present a logic model (DEAL) of this type of moral discourse that makes use of recent research in deontic, epistemic, and action logic, and indicate – drawing upon recent research in computer implementations of modal logic – how information systems may be developed that implement the proposed formalization.

We argue that nano-technology in the form of invisible tags, sensors, and Radio Frequency Identity Chips (RFIDs) will give rise to privacy issues that are in two ways different from the traditional privacy issues of the last decades. One, they will not exclusively revolve around the idea of centralization of surveillance and concentration of power, as the metaphor of the Panopticon suggests, but will be about constant observation at decentralized levels. Two, privacy concerns may not exclusively be about constraining information (...) flows but also about designing of materials and nano-artifacts such as chips and tags. In discussions about justice, development, well-being and equality, the capability approach (CA)Footnote1 founded by economist Amartya Sen and philosopher Martha Nussbaum attaches central importance to individual human capabilities. These are the effective freedoms or real opportunities of people to achieve valuable ‘beings and doings’ (also called ‘functionings’ by capability theorists). Resources—including technical artifacts—may contribute to the expansion of one’s capabilities, but there may also be all sorts of ‘conversion factors’ in place that prevent this. The approach highlights the ‘multidimensionality’ of (...) well-being and sees people as active agents shaping their own lives. In 1998 Sen won the Nobel Prize in economics for his work, which has deeply influenced the United Nations Development Program (UNDP). In the field of development studies the CA has indeed gained popularity, but this is not the only area of application. (shrink)

The development of ever smaller integrated circuits at the sub-micron and nanoscale—in accordance with Moore’s Law—drives the production of very small tags, smart cards, smart labels and sensors. Nanoelectronics and submicron technology supports surveillance technology which is practically invisible. I argue that one of the most urgent and immediate concerns associated with nanotechnology is privacy. Computing in the twenty-first century will not only be pervasive and ubiquitous, but also inconspicuous. If these features are not counteracted in design, they will facilitate (...) ubiquitous surveillance practices which are widely available, cheap, and intrusive. It is argued that Pettit’s conception of “contestatory democracy” is superior to deliberative, direct and epistemic democracy. The strong and weak points of these conceptions are discussed drawing upon the work of a.o Bruce Bimber. It is further argued that ‘contestation’ and ‘information’ are highly relevant notions in thinking about, just, viable and sustainable design for E-democracy.

In this paper we present an executable approach to model interactions between agents that involve sensitive, privacy-related information. The approach is formal and based on deontic, epistemic and action logic. It is conceptually related to the Belief-Desire-Intention model of Bratman. Our approach uses the concept of sphere as developed by Waltzer to capture the notion that information is provided mostly with restrictions regarding its application. We use software agent technology to create an executable approach. Our agents hold beliefs about the (...) world, have goals and commitment to the goals. They have the capacity to reason about different courses of action, and communicate with one another. The main new ingredient of our approach is the idea to model information itself as an intentional agent whose main goal it is to preserve the integrity of the information and regulate its dissemination. We demonstrate our approach by applying it to an important process in the insurance industry: applying for a life insurance. In this paper we will: (1) describe the challenge organizational complexity poses in moral reasoning about informational relationships; (2) propose an executable approach, using software agents with reasoning capacities grounded in modal logic, in which moral constraints on informational relatio nships can be modeled and investigated; (3) describe the details of our approach, in which information itself is modeled as an intentional agent in its own right; (4) test and validate it by applying it to a concrete ‘hard case’ from the insurance industry; and (5) conclude that our approach upholds and offers potential for both research and practical application.
